RESOLUTION
OF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND
AWARDING THE CONSTRUCTION CONTRACT IMPROVEMENTS
FOR ENHANCED NUTRIENT REMOVAL, BOWIE WASTEWATER TREATMENT PLANT, TO WHITING-TURNER CONTRACTING CO., INC.
WHEREAS, the City of Bowie requested Proposals to upgrade the City’s wastewater treatment plant with enhanced nutrient removal technologies in accordance with certain specifications and documents; and
WHEREAS, in the Request for Proposals, the City reserved the right to reject any and all bids or portions thereof; and
WHEREAS, in the Instructions to Bidders, the City reserved the right to reject any bid if the evidence submitted by the bidder or an investigation of such bidder fails to satisfy the City that such bidder is properly qualified to carry out the obligations of the contract; and
WHEREAS, Section 61 of the City Charter provides that, in responding to bid proposals the City shall award the contract to “the bidder who submits the lowest responsive bid with consideration of factors such as the lowest price, quality of work or goods, ability to deliver goods or complete work promptly, and the bidder’s demonstration of overall qualifications and assurances to provide or maintain the equipment or services for which the bid is submitted.”; and
WHEREAS, in response to the Request for Proposals, the City received eleven bids; and
WHEREAS, the City of Bowie, through its Engineer, George, Miles & Buhr, LLC (“GMB”), evaluated the eleven proposals and checked references submitted; and
WHEREAS, the City of Bowie, based upon the recommendations of GMB, has determined to award the contract to Whiting-Turner Contracting Co., Inc. of Baltimore, Maryland, the second lowest bidder. The City concludes that Whiting-Turner is best able to perform the work required, given the time sensitive nature of the project; that the responses for references provide greater assurance as to Whiting-Turner’s reliability and its ability to complete the project of this magnitude within the project time constraints; and that Whiting-Turner’s reputation establishes its strong capability for working cooperatively with clients and to perform work in a manner which equals or exceeds the requirements of the Proposal.
NOW, THEREFORE, BE IT RESOLVED that the City of Bowie awards the Construction Contract Improvements for Enhanced Nutrient Removal, Bowie Wastewater Treatment Plant, to Whiting-Turner Contracting Co., Inc. in the amount of $9,027,500.00; and
BE IT FURTHER RESOLVED that this award is contingent upon approval from the State of Maryland Board of Public Works; and
BE IT FURTHER RESOLVED that the City enter into a contract with Whiting-Turner in a form satisfactory to the City.
