Subject:            First Amendment to the Clearwire US LLC Lease – R-19-10

Date:                March 17, 2010

            The City has been approached by Clearwire US LLC about modifying the lease the City has with Clearwire US LLC to relocate communication antennas on the City’s water tower located at 3107 Belair Drive. 

            Clearwire US LLC desires to move their communication antennas to a higher location on the water tower in exchange for an increase in rent of $400 per month or $4,800 per year.  The current rent that Clearwire US LLC pays on this site is $3,168 per month or $38,016 per year.  This modification thus represents a 12.63% increase.

            The Superintendent at the Water Plant has evaluated this proposal and has determined that there would be no adverse impact on the water tank as a result of this modification.      

STAFF RECOMMENDATION

            Staff feels that the increased rent offered to the City for relocating antennas higher on the water tower represents fair compensation to the City for this request.  Therefore,  staff urges Council to adopt Resolution R-19-10 approving the First Amendment to the Wireless US LLC Lease.
