RESOLUTION R-28-02

OF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND,
STATING THAT THE CITY IS THE OWNER OF THE PROPERTY BETWEEN THE NASH PROPERTY AND THE BELAIR DRIVE RIGHT-OF-WAY AND THAT NO ACCESS EXISTS ACROSS THIS CITY PROPERTY TO THE NASH PROPERTY



WHEREAS, the Council of the City of Bowie, Maryland is responsible to maintain and manage Belair Drive as a municipal street; and

WHEREAS, the City of Bowie owns land parallel to the south side of the Belair Drive right-of-way that is park land; and

WHEREAS, the privately owned Nash Property is zoned R-R allowing a density of 1.85 single-family detached homes per acre; and

WHEREAS, there is a proposed Special Exception on the Nash Property for a Planned Retirement Community that would contain nearly 600 condominium and townhouse units.

NOW, THEREFORE, BE IT RESOLVED, by City Council in legislative session assembled:

1) That the Nash Property has no use of and no right to claim use of City property to gain access to Belair Drive; and
2) That the City Council does not now grant use over City property to gain access to Belair Drive; and
3) That the City Council remains opposed to the Special Exception for a Planned Retirement Community on the Nash Property.
