Access Restriction Agreement
Parcel V and Everst Drive
Bowie Town Center

Attached are Resolution #R-68-02 and an Access Restriction Agreement between RBM Bowie Town Center, Hospitality Development Company, LLC and the City. RBM is the owner of Parcel V, which is the subject of a Specific Design Plan to construct an extended stay hotel on Parcel V in the Bowie Town Center. Hospitality is the developer/applicant of the hotel project and contract purchaser of Parcel V. RBM, Hospitality and the City have been working on a draft Access Restriction Agreement that would allow access to Everst Drive from Parcel V for emergency vehicles only. The parties agree that this restriction is necessary in order to protect the health, safety and welfare of residents on Everst Drive and to reduce the impact and damage of commercial traffic to Everst Drive.
The Access Restriction Agreement has been reviewed and approved by the City Attorney.
It is recommended that the City Council adopt Resolution #R-68-02 authorizing the City Manager to execute the Access Restriction Agreement.

RESOLUTION
OF THE CITY COUNCIL OF BOWIE, MARYLAND AUTHORIZING THE CITY MANAGER TO EXECUTE
AN ACCESS RESTRICTION AGREEMENT BETWEEN PARCEL V IN THE BOWIE TOWN CENTER
AND EVERST DRIVE
WHEREAS, RBM Bowie Town Center Limited Partnership ("RBM") is the
owner of certain real property with frontage on Everst Drive and Town Center
Boulevard (extended) known as Parcel V in the Bowie Town Center; and,
WHEREAS, Hospitality Development Company LLC ("Hospitality") is the contract Purchaser of Parcel V; and,
WHEREAS, Hospitality intends to construct an extended stay hotel on Parcel V, pursuant to Specific Design Plan #SDP-9603/01; and,
WHEREAS, RBM, Hospitality and the City of Bowie ("the City") desire to restrict vehicular access from Parcel V to Everst Drive to emergency vehicles only in order to protect the health, safety and welfare of residents on Everst Drive and to reduce the impact and damage of commercial traffic on Everst Drive.
NOW THEREFORE BE IT RESOLVED, that the Council of the City of Bowie, Maryland approves the access restriction agreement and authorizes the City Manager on behalf of the City to execute the Access Restriction Agreement between RBM, Hospitality and the City.
