MEMORANDUM

TO: City Council

FROM: David J. Deutsch, City Manager

SUBJECT: Status Report/Council Poll

DATE: May 17, 2007

Status Report

1. Claims and Reimbursement Account

Councilman Conroy asked staff to determine why the claims and reimbursement account is so far over budget at $176,000 collected so far this fiscal year. The increase in Claims and Reimbursements Income is mostly attributed to payment from LGIT for damages to City vehicles totaling over $90,000 and other reimburse-ments from CableCom and Verizon for damages totaling over $50,000.

2. Melford Conceptual and Detailed Site Plans

The City has been advised that the Planning Board's reconsideration hearing on the Melford Conceptual Site Plan, scheduled for May 24th, will not be heard by the Planning Board. The attached letter from the Planning Board Administrator indicates that because the case is currently on appeal to the District Council, the Planning Board no longer has jurisdiction. The appellants in the CSP appeal have consequently amended their request for oral argument to include information related to the Corrected Resolution approved by the Planning Board in April. In addition to the above activity, this week the City received a copy of a letter from Richard K. Reed, representing St. John Properties, that indicates their intent to file a Detailed Site Plan containing 200,000 square feet of office space and 300,000 square feet of flex space located along US 50, east of the existing flex space. The pending CSP shows this type of development in this portion of the property. A Stakeholders Meeting will be scheduled on this proposal in the near future, with City hearings to follow.

3. Railroad Realignment

Enclosed in your package is a copy of a May 4, 2007 Washington Post editorial which questions the wisdom of spending over $4 billion to reroute rail traffic around Washington.
